Well, it could be legal... but if it was, there wouldn't be a need to download it.

At least I think its still legal to download music you already own

I'm pretty sure the company isn't losing money from this site. Besides the Bangai-O compilation CDs they made, they are not losing much profit. This is also helped by the fact that this is a rather small community.
